4. The Trustees shall hold the Trust Fund for charitable purposes exclusively. 5. For the purposes of implementing the provisions of Clause 4. hereof: (i) Until the Termination Date, the Trustees shall from time to time and at any time in their uncontrolled discretion, but subject always to the discretionary powers conferred on them under Clause 7 hereof, pay or apply the capital or the income of the Trust Fund, in sums of such amount as the Trustees in their absolute discretion may decide, in any one or more or all of the following ways, videlicet:- (a) To or for the benefit of such one or more Charitable Institution or Charitable Institutions as the Trustees in their uncontrolled discretion may from time to time select; or (b) In implementing or assisting to implement any charitable purpose or charitable purposes which the Trustees in their uncontrolled discretion may from time to time by Minute resolve upon. (ii) On the Termination Date, or if the earlier on the date the Trustees resolve to wind up and dissolve the Trust hereby created, the Trustees shall forthwith pay and apply the whole capital then in their hands, subject to any final expenses, to such Charitable Institution or Charitable Institutions as they in their uncontrolled discretion shall select. 6. No payment shall be made by the Trustees under Clauses 4 or 5 hereof, either: (i) To any Charitable Institution unless at the time such Charitable Institution is a charity as defined in sub-clause 1.(iii) above; or (ii) for any purpose other than a charitable purpose as defined in sub-clause 1.(iii) above.

Charity accounts and constitution – what information do we publish?

From April 2016 we began to publish charities’ accounts, initially for those charities with an annual income of £25,000 or more, and for all SCIOs.

When a charity publishes its accounts on its website and has supplied us with a link, we have made this available. From late 2017, where the charity is a company, a registered social landlord or is also registered with the Charity Commission for England and Wales, a link is provided to the relevant regulator’s website where the accounts are made available. We accept no responsibility for the functionality, accuracy, or content of external websites – if you experience a technical issue with an external link, you should contact the charity directly.

You have the right to the following information under section 23 (1)(a) and (b) of the Charities and Trustee Investment (Scotland) Act 2005, from the charity direct:

  • a copy of the charity’s latest statement of accounts
  • a copy of the charity’s constitution.

In addition to the above, a charity may also be able to provide you with previous years’ accounts and constitutions, although it is not obliged to do so. You can contact the charity to request this information using the contact details on the charity’s Register entry.
