The Trustees shall hold the Trust Fund and the income of it to pay and apply the same to or for the benefit of or in furtherance of such charitable purposes or charitable institutions in such proportions and manner as the Trustees shall think fit. 1.2 In this deed the following expressions shall have the following meanings:- "the 2005 Act" shall mean the Charities and Trustee Investment (Scotland) Act 2005; "charity trustee" shall mean a charity trustee as defined in section 106 of the 2005 Act or section 78 of the Charities Act 2006 (as applicable) or, where a charitable institution is governed by the law of an overseas territory, shall mean the equivalent individuals under equivalent legislation; "charitable purpose" shall mean a charitable purpose under section 7 of the 2005 Act which is also regarded as a charitable purpose in relation to the application of the Taxes Acts; "charitable institution" shall mean (i) a charity in terms of the 2005 Act which is also regarded as a charity in relation to the application of the Taxes Acts; or (ii) a charity under the law of any other jurisdiction which is also regarded as a charity in relation to the application of the Taxes Acts, provided that nothing in these presents shall authorise an application of the property of the Trust other than in furtherance of a charitable purpose; and "the Trust Fund" means (i) the Initial Fund; (ii) any other property of any description which may be made over to the Trustees for the purposes of this Trust; (iii) any property from time to time representing the Initial Fund or property within (ii) above; (iv) accumulations of income. "The Trustees" means the Founding Trustees or the trustees of this Trust for the time being. 1.3 In this Deed of Trust unless the context otherwise requires: (i) the singular includes the plural and vice versa; (ii) the masculine includes the neuter and each includes the feminine; (iii) any reference to "the Trust Fund" includes a reference to any part of it; (iv) any reference to "this deed" means this Deed of Trust; (v) References to any Act include references to any statutory modification or re-enactment thereof and any subordinate legislation made under it.

From 09 March 2026, OSCR is required by law to publish the names of a charity’s trustees as part of its Scottish Charity Register entry.   • its annual report and full accounts, if submitted after 9 March 2026
    (Accounts submitted prior to 9 March 2026 will be redacted, or may not be published, depending on the charity’s income level or legal form.)

These changes are designed to improve transparency across the charity sector in Scotland.
