Objects 4 The company’s objects are: (a) The relief of those in need, by reason of youth, age, ill-health, disability, financial hardship or other disadvantage (b) The prevention or relief of poverty. The expressions ‘charitable purpose’ or ‘charitable object’ shall mean a charitable purpose under section 7 of the 2005 Act which is also regarded as a charitable purpose in relation to the application of the Taxes Acts and a ‘charitable institution’ shall mean a charity in terms of the 2005 Act which is also regarded as a charity in relation to the application of the Taxes Acts, or a charity under the law of any other jurisdiction which is also regarded as a charity in relation to the application of the Taxes Acts, provided that nothing in these Articles shall authorise an application of the property of the Company other than in furtherance of a charitable purpose. 5 The company’s objects are restricted to those set out in article 4 (but subject to article 6). 6 The company may (subject to first obtaining the consent of OSCR) add to, remove or alter the statement of the company’s objects in article 4; on any occasion when it does so, it must give notice to the registrar of companies and the amendment will not be effective until that notice is registered on the register of companies.

Charity accounts and constitution – what information do we publish?

From April 2016 we began to publish charities’ accounts, initially for those charities with an annual income of £25,000 or more, and for all SCIOs.

When a charity publishes its accounts on its website and has supplied us with a link, we have made this available. From late 2017, where the charity is a company, a registered social landlord or is also registered with the Charity Commission for England and Wales, a link is provided to the relevant regulator’s website where the accounts are made available. We accept no responsibility for the functionality, accuracy, or content of external websites – if you experience a technical issue with an external link, you should contact the charity directly.

You have the right to the following information under section 23 (1)(a) and (b) of the Charities and Trustee Investment (Scotland) Act 2005, from the charity direct:

  • a copy of the charity’s latest statement of accounts
  • a copy of the charity’s constitution.

In addition to the above, a charity may also be able to provide you with previous years’ accounts and constitutions, although it is not obliged to do so. You can contact the charity to request this information using the contact details on the charity’s Register entry.
