The Trustees shall hold and apply the Trust Funds under their charge both as to capital and income for charitable purposes only within the meaning of the Income and Corporation Taxes Act 1970 and any provisions for the time being in force amending or superseding the same and the Trustees shall make payments therefrom at such time or times and of such amount or amounts as they in their sole discretion may determine to or for behoof of any person fund institution or society who is qualified to benefit by a gift for charitable purposes only and that whether they are situate or established in Scotland or elsewhere declaring that the Trustees need not allocate the whole income of any particular year but may add part or the whole of the income as they in their sole discretion should think fit to the capital of the Trust or to an income reserve fund or funds. (THIRD) The Trustees may if they in their sole discretion unanimously so decide, after meeting all liabilities, dispose of the whole Trust Funds remaining in their hands by distributing these funds to or among any suitable object or objects qualified to receive gifts for charitable purposes only and thus bring the Trust to an end.

Charity accounts and constitution – what information do we publish?

From April 2016 we began to publish charities’ accounts, initially for those charities with an annual income of £25,000 or more, and for all SCIOs.

When a charity publishes its accounts on its website and has supplied us with a link, we have made this available. From late 2017, where the charity is a company, a registered social landlord or is also registered with the Charity Commission for England and Wales, a link is provided to the relevant regulator’s website where the accounts are made available. We accept no responsibility for the functionality, accuracy, or content of external websites – if you experience a technical issue with an external link, you should contact the charity directly.

You have the right to the following information under section 23 (1)(a) and (b) of the Charities and Trustee Investment (Scotland) Act 2005, from the charity direct:

  • a copy of the charity’s latest statement of accounts
  • a copy of the charity’s constitution.

In addition to the above, a charity may also be able to provide you with previous years’ accounts and constitutions, although it is not obliged to do so. You can contact the charity to request this information using the contact details on the charity’s Register entry.
