Inquiry Report: SC017869 Deansmeadow Allotment Association

The Scottish Charity Regulator (OSCR) has today published an inquiry report for Deansmeadow Allotment Association, Scottish charity number SC017869.

We opened an inquiry following receipt of concerns about the charity’s governance. We assessed that there were some regulatory issues that we needed to make inquiries about.

In the course of the inquiry, it became clear that the charity trustees required support so that they could properly understand their charity trustee duties as set out in the Charities and Trustee Investment (Scotland) Act 2005. The charity have engaged support from their local Third Sector Interface (TSI) organisation to help them with this.

OSCR has concluded that it is neither necessary nor proportionate to take formal action in relation to the historical failure of the charity trustees to meet their duties. We have issued the charity with recommendations to help it move forward. The charity trustees will need time to implement these, and it is important that they are given a fair opportunity to do so.

Our report is published to aid understanding of those with an interest in the charity about OSCR’s inquiry. We have also highlighted some learning points for other charities and those who work with charities to consider.
